These Website Terms and Conditions govern the use of the Luddite website and the purchase of products through our online store.

By accessing this website, creating an account or placing an order, you confirm that you have read, understood and agreed to these Terms and Conditions.

If you do not agree to these terms, you should not use this website or place an order through it.

  • “Products” refers to the wines, merchandise and other goods offered for sale through the website.

3. Age Restriction

Alcohol may not be sold or supplied to anyone under the age of 18.

By accessing the online store or placing an order containing alcoholic products, you confirm that:

  • You are at least 18 years old;
  • You are legally permitted to purchase alcohol;
  • The information you provide is accurate; and
  • The person accepting delivery will be at least 18 years old.

We and our delivery partners reserve the right to request valid identification before completing a sale or handing over an order.

An order may be withheld, cancelled or returned if satisfactory proof of age cannot be provided.

4. Use of the Website

You agree to use the website only for lawful purposes.

You may not:

  • Use the website in a way that violates any law or regulation;
  • Attempt to gain unauthorised access to the website, server or customer information;
  • Introduce viruses, malicious code or other harmful technology;

We make reasonable efforts to ensure that product descriptions, photographs, vintages, quantities and other information are accurate.

  • Product images are provided for illustrative purposes;
  • Colours and packaging may differ slightly from the images displayed;
  • Bottle labels and packaging may change without notice;
  • Vintages may change depending on availability; and
  • Minor variations may occur between batches.

Where a specific vintage is important to your purchase, please contact us before placing your order.

6. Product Availability

All products are subject to availability.

Placing a product in your cart does not reserve it. A product is only allocated to your order once payment has been successfully completed and the order has been accepted.

If a product becomes unavailable after you have placed an order, we may:

  • Contact you to arrange a suitable substitute;
  • Issue a store credit, with your agreement;
  • Refund the unavailable product; or
  • Cancel and refund the affected order.

We will not substitute a product without your consent.

7. Prices

All prices are displayed in South African rand.

Prices are inclusive of VAT, where applicable.

Delivery, packaging and other additional charges are not included in the product price unless expressly stated. These charges will be displayed during checkout before payment is completed.

We may change our prices at any time without prior notice. A price change will not affect an order that has already been accepted and paid for.

8. Pricing and Website Errors

We take reasonable care to ensure that pricing and product information are correct. However, errors may occur.

If a product is displayed at an obviously incorrect price or contains a material description error, we may reject or cancel the order before dispatch.

Where payment has already been made, the amount paid for the affected product or order will be refunded.

We are not obliged to supply a product at a price that is clearly the result of a typographical, technical or administrative error.

9. Placing an Order

Products displayed on the website constitute an invitation to place an order and do not represent a binding offer by Luddite.

Before submitting an order, you will be given an opportunity to:

  • Review the products selected;
  • Review the total price and delivery charges;
  • Correct any errors; and
  • Accept these Terms and Conditions.

Your order constitutes an offer to purchase the selected products.

An order is only accepted once:

  • Payment has been successfully received or authorised;
  • We have confirmed acceptance of the order; and
  • The order has not been rejected due to availability, pricing, fraud prevention or legal restrictions.

An automated order acknowledgement does not necessarily mean that the order has been accepted.

10. Payment

Payment may be made using the methods displayed during checkout.

You confirm that:

  • You are authorised to use the chosen payment method;
  • The billing information supplied is accurate; and
  • Sufficient funds are available to complete the transaction.

Payments may be processed by an independent third-party payment provider. We do not ordinarily receive or store complete card details entered through a secure third-party payment gateway.

We reserve the right to delay or cancel an order where payment cannot be verified or fraud is suspected.

11. Order Confirmation

Once an order has been accepted, an order confirmation will be sent to the email address provided during checkout.

You are responsible for checking the confirmation and notifying us promptly of any errors.

Please retain your order confirmation and proof of payment for your records.

12. Order Cancellations

You may request cancellation before the order has been processed or dispatched.

Cancellation requests must be sent to info@luddite.co.za and must include your order number.

We cannot guarantee that an order can be cancelled once processing has begun.

Where an order has already been dispatched, it will be dealt with under our Refunds and Returns Policy.

Any delivery, interception, collection or return courier costs arising from a customer-requested cancellation will be payable by the customer, unless otherwise required by law.

13. Delivery Areas

We currently deliver within South Africa.

We reserve the right not to deliver to certain addresses or regions due to courier limitations, safety concerns, legal restrictions or excessive delivery risk.

Delivery to farms, remote areas, estates, game reserves or other restricted locations may require:

  • Additional delivery charges;
  • Alternative collection arrangements;
  • Additional delivery time; or
  • Delivery to the nearest accessible town or depot.

Any additional costs will be communicated before dispatch where reasonably possible.

14. Delivery Addresses

You are responsible for supplying a complete and accurate delivery address, contact number and recipient name.

Luddite will not be responsible for delays, failed deliveries or additional costs caused by:

  • An incorrect or incomplete address;
  • Incorrect contact information;
  • Restricted access to the delivery location;
  • The recipient being unavailable;
  • A failure to disclose that the destination is remote or difficult to access; or
  • A person under the age of 18 attempting to accept an alcohol delivery.

Any costs incurred in correcting an address, redirecting a shipment, arranging a second delivery or returning an undeliverable order will be payable by the customer, unless the error was caused by Luddite.

15. Delivery Timeframes

Delivery timeframes displayed on the website or provided by us are estimates only.

Delivery may be affected by:

  • Courier delays;
  • Weather conditions;
  • Road closures;
  • Public holidays;
  • Peak trading periods;
  • Remote delivery locations;
  • Labour disruptions;
  • Security restrictions; or
  • Events beyond our reasonable control.

We will make reasonable efforts to assist with delayed deliveries but cannot guarantee a particular delivery date unless expressly agreed in writing.

16. Receipt of Delivery

The person accepting an alcohol delivery may be required to:

  • Provide valid proof that they are at least 18 years old;
  • Provide their name and signature;
  • Supply a delivery code or confirmation;
  • Present identification; or
  • Permit the courier to record proof of delivery.

Delivery to a person at the address supplied may be regarded as delivery to the customer, provided that person appears authorised to accept the order and is at least 18 years old.

Customers should inspect parcels on delivery where reasonably possible.

17. Risk and Ownership

Ownership of the products passes to you once full payment has been received.

Risk of loss or damage passes to you when the order is delivered to the address supplied or collected by you or your nominated representative.

This does not limit any rights you may have where products are damaged before delivery or supplied incorrectly.

18. Damaged, Incorrect or Missing Products

You should inspect your order promptly after delivery.

Please notify us within 48 hours if:

  • A bottle is broken or leaking;
  • The incorrect product was supplied;
  • Products are missing; or
  • The parcel appears to have been materially damaged during delivery.

Your notification should include:

  • Your order number;
  • A description of the problem;
  • Clear photographs of the product;
  • Photographs of the internal and external packaging; and
  • Photographs of the courier label.

Please retain the products and packaging until the matter has been assessed.

Claims will be handled in accordance with our Refunds and Returns Policy and applicable consumer legislation.

19. Returns and Refunds

Returns, exchanges, damaged products, defective products and refunds are governed by our Refunds and Returns Policy, which forms part of these Terms and Conditions.

Unless otherwise required by law:

  • Original delivery charges are non-refundable;
  • Return shipping costs are payable by the customer;
  • Collection charges are payable by the customer;
  • Luddite is not responsible for customer-incurred shipping expenses; and
  • The customer remains responsible for returned products until they are safely received by Luddite.

Products must not be returned without prior written approval and return instructions.

Nothing in these terms limits a consumer’s rights in relation to defective, unsafe, incorrectly supplied or misrepresented goods.

20. Cooling-Off Rights

Where a statutory cooling-off period applies to an electronic transaction, it will be dealt with in accordance with applicable South African law.

Any right to cancel may be subject to legal exclusions, return conditions and responsibility for the direct cost of returning the products.

Due to the nature of certain products, some goods may not qualify for return once opened, consumed, personalised or otherwise made unsuitable for resale, except where the product is defective or incorrectly supplied.

21. Promotions and Discount Codes

Promotions, discount codes and special offers:

  • Are valid only for the period stated;
  • May be limited to selected products;
  • May be subject to minimum order values;
  • Cannot be exchanged for cash;
  • May not be used with another promotion unless expressly permitted;
  • May be limited to one use per customer; and
  • May be withdrawn where fraud, misuse or an error is suspected.

Discount codes must be applied during checkout and cannot ordinarily be added after an order has been submitted.

22. Gift Vouchers

Where gift vouchers are offered:

  • They may only be used through the approved sales channel;
  • They cannot be exchanged for cash, except where required by law;
  • Any expiry date will be displayed on the voucher;
  • Lost or stolen vouchers may not be replaced;
  • The customer is responsible for protecting the voucher code; and
  • Any remaining balance will be dealt with according to the voucher terms.

23. Customer Accounts

You may be required to create an account to access certain website features.

You are responsible for:

  • Keeping your login details confidential;
  • Preventing unauthorised access to your account;

To the fullest extent permitted by law, Luddite will not be liable for indirect, incidental, special or consequential losses arising from:

  • Delayed delivery;

  • Unauthorised access caused by the customer’s failure to protect login details; or
  • Events beyond our reasonable control.

Our liability for a direct claim relating to an order will, where legally permitted, be limited to the amount paid for the affected product or order.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability arising from gross negligence or rights granted under applicable consumer legislation.
